If you’re injured on the job by someone who is not affiliated with your employer, this is known as a third-party claim. In that case, you can receive benefits from your own employer, including medical and wages. At the same time, you can pursue this third party claim against the at-fault party. An example of this would be if you are making a delivery on behalf of your employer and you are involved in a motor vehicle accident. In that situation, you can pursue your workers’ compensation claim and also pursue a claim against the at-fault driver.
